These Terms govern your use of the emberaide website, waitlist, content, and any pre-release experience that links to them. By using those services, you agree to these Terms. Product-specific or beta terms presented later will also apply and will control if they directly conflict with these website Terms.
1. Eligibility
You must be at least 18 years old and able to enter a binding agreement to use the waitlist or beta services. If you use emberaide on behalf of an organization, you represent that you have authority to bind that organization.
2. Beta waitlist and Founding 100 offer
- Joining the waitlist requests communication about beta access. It does not create a paid subscription, guarantee access, or require a payment card.
- Access may open in small cohorts based on product readiness, capacity, and useful testing needs.
- The first 100 eligible beta testers offered a Founding 100 place receive 60 days of beta access without a subscription fee, subject to the invitation terms.
- After the free period, eligible founding users may keep a $19 per month price for as long as the paid account remains continuously active. Taxes may apply.
- If a founding subscription is cancelled, expires, or payment fails beyond any stated grace period, the founding price may not be available again.
- Pre-release features may change, contain errors, or be suspended. Important business information should be backed up independently.
3. Accounts and security
When accounts become available, you are responsible for accurate registration information, safeguarding access credentials, and activity under your account. Notify us promptly if you suspect unauthorized access. You may not share access in a way that bypasses plan limits or security controls.
4. Acceptable use
You may not use emberaide to:
- break the law, infringe another person’s rights, or submit content you do not have permission to use;
- harass, threaten, defraud, exploit, or harm another person;
- upload malicious code, overload the service, bypass access controls, or probe for vulnerabilities without written permission;
- scrape, reverse engineer, resell, or use automated means to access the service except as permitted by law or written authorization;
- use outputs as the sole basis for medical, legal, financial, employment, credit, housing, or other high-impact decisions; or
- misrepresent automated output as verified professional advice.
5. Your content and feedback
You retain ownership of content you submit. You grant emberaide a limited, worldwide license to host, copy, process, transmit, and display that content only as needed to operate, secure, support, and improve the service consistent with the Privacy Policy and your settings.
If you provide ideas or feedback, you allow emberaide to use them without restriction or payment, provided we do not publicly identify you without permission.
6. emberaide content and intellectual property
The website, product design, software, brand, and original content are owned by emberaide or its licensors and protected by intellectual-property laws. These Terms give you a limited, personal, revocable, non-transferable right to use the services for their intended purpose. No other rights are granted.
7. Productivity tool, not medical advice
emberaide is a productivity and operations tool designed with ADHD founders in mind. It is not a healthcare provider and does not diagnose, treat, prevent, or cure any condition. Information and automated suggestions are not medical, psychological, legal, tax, or financial advice and do not replace a qualified professional.
8. Automated suggestions
Automated systems may organize content, estimate priorities, or suggest plans. Outputs can be incomplete, inaccurate, or inappropriate for your circumstances. You are responsible for reviewing outputs and deciding whether to use them, especially for deadlines, commitments, or business decisions.
9. Third-party services and links
The website or product may link to or integrate with third-party services. Their terms and privacy practices govern your use of those services. emberaide is not responsible for third-party content, availability, or conduct.
10. Availability, changes, and termination
We may modify, suspend, or discontinue features; set reasonable usage limits; or restrict access when needed for security, legal compliance, misuse, or service operations. Where practical, we will provide notice of material changes that negatively affect a paid service. You may stop using the website or leave the waitlist at any time.
11. Disclaimers
To the fullest extent permitted by law, the website and pre-release services are provided “as is” and “as available.” emberaide disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. Nothing in these Terms limits a warranty or consumer right that cannot legally be excluded.
12. Limitation of liability
To the fullest extent permitted by law, emberaide will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from the website or a pre-release service. Any aggregate liability will not exceed the greater of the amount you paid emberaide for the affected service during the previous 12 months or US $100. These limits do not apply where prohibited by law.
13. General terms
If part of these Terms is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; emberaide may transfer them as part of a reorganization or sale. Applicable law and mandatory consumer protections remain unaffected.
